Experian Data Quality Scholarship Official Rules (“Official Rules”)

OverviewExperian Data Quality’s (“EDQ”) aim is to engage students and showcase their creativity in expressing the power of data in their daily passions. EDQ challenges students to create a video and write a short essay explaining the role data plays in our daily lives.

SPONSOR:  Experian Data Quality (“EDQ”), with an office at 125 Summer Street, Suite 1910, Boston, MA 02110.

ELIGIBILITY:  The 2016 Experian Data Quality Contest (“Contest”) is open only to individuals age eighteen (18) or older who are currently enrolled; in good academic standing; and in or entering their final year at an accredited college or university (“School”) in the United States (“Entrants”). Entrants must complete an entry form, which is located on the Contest webpage.  Employees and interns of Experian or its affiliates and their immediate family members (children, domestic partner, parents, siblings and spouse) and others living in their household are not eligible or are excluded from the contest.

AGREEMENT:  All participants must abide by the Official Rules and any decisions by EDQ, which are final and binding in all matters related to this contest.  Winning is contingent upon fulfilling all requirements set forth herein.  All Contest entries and associated videos become the property of EDQ.  All Contest entries are subject to verification and will be declared invalid if they do not follow the criterion provided, or if they are forged or falsified within any way.  By entering the contest, Entrants consent to the use of their image or video in any future form(s) of publicity of EDQ, without further notice or compensation. By participating in this contest, entrants acknowledge compliance with, and agree to be bounded by all Official Rules.

All Entrants release and hold harmless EDQ from and against any and all manner of action, causes of action, suits, debts, covenants, contracts, claims and demands, including legal fees and expenses, whatsoever, including but not limited to, claims based on negligence, breach of contract and fundamental breach and liability for physical injury, death, intellectual property infringement, false light, misappropriation, publicity rights, or property damage which the Entrants or his/her administrators, heirs, successors or assigns might have or could have, by reason of or arising out of the Entrant’s participation in the contest and/or in connection with the acceptance and/or exercise by the Entrant of the prize awarded.

SUBMISSION PERIOD:  Submission period begins on [05/01/2016/ 12:00 AM] Eastern Time (EST) and ends on [08/31/2016/ 11:59 PM] (“Contest Period”).  EDQ is the official time keeper for the Contest Period.  Entries received outside of the Contest Period will not be considered for the Contest.

HOW TO ENTER:  To enter, visit the contest page and review the Official Rules and terms. During the Contest Period, complete an entry form online and submit it to EDQ Website in accordance with the submission instructions.

Technical and content guidelines Each video must comply with the guidelines and technical specifications provided in the Official Rules and the following general guidelines:

  • Video must comply with the technical specifications provided in the Contest Rules and must be compatible with the upload mechanism required by the Official Rules;
  • Video and all video content must be owned solely by the entrant;
  • Video may not have been previously published or won any award;
  • Video must be original;
  • Video must not prominently (as determined by EDQ in its discretion) depict or refer to any brand or trademark;
  • Video must not contain any material that violates or infringes upon the rights of any third party, including without limitation copyrights, trademarks or rights of privacy or publicity, or that is defamatory, threatening, indecent, obscene or offensive, or that is unlawful, in violation of or contrary to any applicable laws or regulations, or whose use by EDQ requires a license or permission or payment to any third party;
  • Video must not contain any material that EDQ, in its sole discretion, deems inappropriate for public viewing.

Additionally, Entrants must submit a short essay (no longer than 1000 words) accompanying the video.

SELECTION OF FINALISTS: EDQ will establish a committee, who has sole discretion in selecting up to ten finalists from the pool of entrants; finalists will be selected based on originality and creativity in their presentation of the impact of data quality.. Finalists’ videos will available online for a thirty (30) day period, after which EDQ will select one winner for the prize.

Certification Finalists will be notified by EDQ and will be required to submit a certified letter of academic good standing from their college or university in order to be eligible for the Prize.

SELECTION OF WINNER: EDQ will select one winner from the pool of finalists. EDQ will select one winner at its sole discretion, but will take into account originality, creativity, clarity, and overall communication. EDQ will announce the winners on or before November 1, 2016.  If the winner does not respond and accept the award within thirty (30) days of the first contact attempt, he or she will be disqualified, and an alternative finalist will be selected for the prize.  All decisions by the judges are FINAL in all matters relating to this contest.

PRIZE:  The prize will consist of $5,000.00 USD (“Prize”) to be awarded as a check made to the winner’s school to be deposited into the winner’s student account within forty-five (45) days of EDQ notifying with winner.

PRIVACY:  Entrants’ contact information will not be passed on to any other companies without Entrants’ expressed permission.

GENERAL RULES: The EDQ is not responsible for late, lost, delayed, illegible, damaged, corrupted or incomplete entries or e-mails, incorrect or inaccurate capture of, damage to, or loss of entries, videos or entry information, any delay or interruption in the launch, accessibility or operation of the website or any entry or voting period or any other human or technical errors of any kind relating to the submission, collection, storage or processing of entries or the administration of the Contest. EDQ is not responsible for undeliverable e-mails resulting from any form of active or passive e-mail filtering by a user’s internet service provider and/or e-mail client or for insufficient space in user’s e-mail account to receive e-mail. EDQ are not responsible for any liability for damage to any computer system resulting from participation in or accessing or downloading information in connection with this promotion. ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS CONTEST IS A VIOLATION OF LAW. SHOULD SUCH AN ATTEMPT BE MADE, EDQ RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW. EDQ reserves the right at its sole discretion to disqualify or prohibit from participating in the Contest any individual who, in EDQ’s discretion, EDQ determines or believes (a) has tampered with the entry process or has undermined the legitimate operation of the Contest by cheating, hacking, deception or other unfair playing practices, or (b) has engaged in conduct that annoys, abuses, threatens or harasses any other entrant or any representative of EDQ, or (c) has attempted or intends to attempt any of the foregoing. EDQ reserves the right, in its sole discretion, to cancel, modify or suspend this Contest should a virus, bug, technical problem, entrant fraud or misconduct, or other causes beyond the control of the EDQ corrupt the administration, integrity, security or proper operation of the Contest or should EDQ not receive a sufficient number of entries of sufficient quality to warrant the selection of sufficient number of winners, as determined by EDQ in its discretion. In the event of termination of the Contest, a notice will be posted online and EDQ in its discretion may select a winner from among all eligible entries received prior to the time of termination if suitable entries are received prior to the time of termination. EDQ reserves the right not to select any finalists or winners if the Contest is terminated early. Entry times will be determined using EDQ’s computer, which will be the official clock for the Contest. All United States federal, state and local laws and regulations apply.

By entering the Contest, Entrants agree that (a) any and all disputes, claims, and causes of action arising out of or connected with the Contest, or any prizes awarded, shall be resolved individually, without resort to any form of class action; and (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Contest, but in no event attorneys’ fees; and (c) under no circumstances will any entrant be permitted to obtain any award for, and entrant hereby waives all rights to claim punitive, special, incidental or consequential damages and any and all rights to have damages multiplied or otherwise increased and any other damages, other than for actual out-of-pocket expenses. Each Entrant’s sole and exclusive remedy with respect to any and all claims, causes of action and/or lawsuits relating to or arising out of the Contest and/or use of the Video shall be an action at law for the recovery of monetary damages only, and in no event shall any of the rights acquired or to be acquired by EDQ or its affiliates hereunder be affected or impaired. Each Entrant agrees that in no event shall the Entrant have the right to enjoin or otherwise interfere with the exercise by EDQ of any of their rights hereunder or to terminate or rescind any of the rights granted herein. Non-compliance with the Official Rules may result in disqualification. Any legal proceedings arising out of this Contest or relating to the Official Rules shall be instituted only in the federal or state courts located in Cook County in the State of Illinois, and the parties consent to jurisdiction therein with respect to any legal proceedings or disputes of whatever nature arising under or relating to these rules.
